Caika accepts copyright complaints concerning content available through the Service. Where United States DMCA procedures apply, notices and counter-notices may use the elements described below. This policy supports a fair notice-and-response process and does not constitute legal advice.
This policy applies to material hosted, displayed, or made publicly accessible through Caika, including images and related prompts or profile information in public galleries. It is intended to support the notice-and-takedown process under the U.S. Digital Millennium Copyright Act (DMCA), including 17 U.S.C. Section 512, where that law applies.
The email address below is Caika's copyright contact for notices concerning the Service. This policy does not represent that the contact is a DMCA agent registered with the U.S. Copyright Office. If a legally required registered-agent listing is established, the official registry entry controls over inconsistent information in this policy.
A copyright owner, or a person authorized to act on the owner's behalf, may request removal or restriction of allegedly infringing material. To be valid under 17 U.S.C. Section 512(c)(3), the notice must be a written communication containing all of the following:
Send a complete notice to support@caika.app with the subject line "Copyright Notice / DMCA Notice." Separate notices may be requested when a submission covers a large number of unrelated items or does not identify their locations clearly.
Caika may forward the notice, including the claimant's contact information, to the user who posted the material or to relevant service providers. Caika may request missing information, remove or disable access to material, notify the affected user, preserve relevant records, or take other appropriate action. Incomplete, unclear, or non-copyright complaints may not be processed as DMCA notices.
The DMCA process is for copyright claims. Reports involving trademarks, privacy, impersonation, illegal content, or other issues should identify the applicable concern and be sent separately to support@caika.app.
If material was removed or disabled because of a mistake or misidentification, the affected user may send a written counter-notice. To be valid under 17 U.S.C. Section 512(g), the counter-notice must contain all of the following:
Send a complete counter-notice to support@caika.app with the subject line "Copyright Counter-Notice / DMCA Counter-Notice." Caika may provide a copy, including the counter-notifier's contact information, to the original claimant.
After forwarding a valid counter-notice, Caika may restore the affected material or access in approximately 10 to 14 business days unless the original claimant informs Caika that it has filed a court action seeking to restrain the allegedly infringing activity. Restoration is not guaranteed when the material independently violates the Terms of Service, applicable law, or another enforceable restriction.
In appropriate circumstances and at Caika's reasonable discretion, accounts of users who repeatedly infringe copyrights may be restricted or terminated. Caika may consider valid notices, counter-notices, court decisions, retractions, surrounding facts, and indications of abusive or mistaken reporting when applying this policy.
Knowingly making a material misrepresentation that content is infringing, or that content was removed by mistake or misidentification, may result in liability under 17 U.S.C. Section 512(f), including damages and legal fees. Consider fair use, licenses, public-domain status, and other lawful uses before submitting a notice. You may wish to consult a qualified attorney if you are uncertain.
Notices and counter-notices are legal communications and should not include unnecessary sensitive information. Caika processes and discloses the information in them as reasonably necessary to investigate the claim, administer the DMCA process, protect legal rights, comply with law, and maintain records, subject to the Privacy Policy.
